Vigil Wiki Terms of Use

These Terms of Use ("Terms") govern your access to and use of the vigil.wiki website, web application, public note pages, and Model Context Protocol ("MCP") integrations for services such as Claude, ChatGPT, and other compatible agents (collectively, the "Service").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Vigil Wiki is

Vigil Wiki is a private note-keeping and note-sharing app. It is meant for notes, drafts, markdown, links, tags, groups, public note pages, and related text material.

Vigil Wiki is not a general-purpose file storage service, media locker, backup drive, software distribution platform, data warehouse, piracy host, or free replacement for cloud-drive products.

The web app is free to use as a personal notebook. MCP access may require a subscription. MCP access allows authorized agents, such as Claude or ChatGPT, to read, create, update, search, and publish notes according to the permissions you grant.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with permission and supervision from a parent or legal guardian.

You may not use the Service if you are prohibited from doing so by applicable law, if we previously terminated your account for serious abuse, or if you are using the Service on behalf of a person or entity that is barred from using it.

3. Accounts and security

You are responsible for:

• providing accurate account information;
• maintaining the security of your account;
• all activity under your account;
• promptly notifying us of unauthorized access; and
• making sure any connected AI client, agent, or integration is authorized and trusted by you.

You may not share, sell, lease, transfer, or misuse account access. You may not bypass access controls, rate limits, billing controls, permission screens, or security features.

4. Plans, subscriptions, billing, and cancellation

The Vigil Wiki web app is free to use as a personal notebook. MCP access requires a paid subscription unless we provide trial, promotional, reviewer, or other free access.

Current MCP subscription prices are:

• Monthly: $3.99 per month
• Annual: $29.99 per year

Prices may change. If pricing changes, we will show the new price before it applies to a new purchase or renewal, except where a change is caused by taxes, fees, payment-provider charges, currency conversion, or other circumstances outside our control.

Subscriptions renew automatically unless canceled before the renewal date. You can cancel through the account or billing controls we provide. Cancellation normally takes effect at the end of the current billing period.

Fees are non-refundable except where required by law or expressly stated by us. If your account is suspended or terminated for violating these Terms, including misuse of the Service for non-text file storage, copyright infringement, illegal content, abuse, security attacks, or evasion, you will not receive a refund except where required by applicable law.

Subscriptions, checkout, invoices, and payment management are handled on vigil.wiki or through our payment processor. Do not enter payment card numbers into notes, MCP tools, public pages, prompts, or support messages.

5. User content

"User Content" means notes, text, titles, tags, groups, slugs, markdown, links, public notes, and other material you create, store, edit, publish, or share through the Service.

You retain ownership of your User Content. You grant Vigil Wiki a limited license to host, store, copy, process, transmit, display, format, render, sanitize, publish, unpublish, and otherwise use your User Content only as needed to provide, secure, support, improve, and enforce the Service.

For private notes, this license is limited to operating the private notebook and authorized integrations. For published notes, the license includes publicly displaying the published note at a vigil.wiki URL until you unpublish or delete it, subject to caching and third-party copies outside our control.

You are solely responsible for your User Content and for making sure you have all rights and permissions needed to store, edit, share, or publish it.

6. Private notes, public notes, and publishing

Notes are private unless you publish them, share them through an authorized integration, or otherwise disclose them.

When you publish a note:

• the note becomes publicly accessible at a vigil.wiki URL;
• anyone with the URL may view it without logging in;
• search engines and archival services may index or copy it;
• other people may quote, link to, screenshot, summarize, or save it; and
• unpublishing removes the public page from Vigil Wiki but cannot remove third-party copies.

Do not publish anything you do not have the right to publish. Do not publish personal data, secrets, confidential information, private communications, or sensitive material unless you are legally permitted to do so and accept the risks of public disclosure.

7. MCP and AI-agent integrations

Vigil Wiki may provide MCP tools and related permissions such as:

• notes:read - read, list, retrieve, or search note content and metadata;
• notes:write - create, edit, update, organize, or delete notes and metadata; and
• notes:publish - publish or unpublish notes to or from the public web.

You must grant permissions before an integration can use them. You are responsible for reviewing permissions and outputs before authorizing an agent to act on your behalf.

AI agents can make mistakes, misunderstand instructions, overwrite text, expose sensitive content, generate inaccurate material, or publish content you did not intend to publish. Use MCP tools carefully, especially tools that write, delete, publish, or otherwise change the state of your account or public content.

Vigil Wiki is not responsible for the actions, outputs, policies, or data handling of third-party AI clients or agent platforms, including Claude, ChatGPT, or any other service you connect.

8. Text-only use and prohibition on binary/file storage

Vigil Wiki is for notes and text material.

You may not use Vigil Wiki to store, transfer, reconstruct, distribute, cache, or hide non-text files or binary data, including:

• music, movies, videos, images, fonts, games, software, datasets, archives, backups, disk images, ROMs, torrents, or media libraries;
• executable files, scripts intended for deployment, malware, payloads, or exploit kits;
• base64, hexadecimal, compressed, encrypted, serialized, deserialized, chunked, obfuscated, or otherwise encoded representations of non-text files;
• file shards split across many notes;
• data intended to be reassembled into a file outside Vigil Wiki; or
• any other use that treats Vigil Wiki as a cloud drive, object store, CDN, backup service, or data exfiltration channel.

For purposes of these Terms, this kind of use is unauthorized and prohibited, even if the data appears as text after encoding, serialization, deserialization, compression, encryption, or chunking.

Any account used to store non-text files or encoded/serialized/deserialized binary material may be suspended or terminated immediately. We may delete the offending data and, where appropriate, the entire account and associated user data. If the account is on a paid tier, no refund will be provided except where required by law.

9. Copyright and intellectual-property rules

You may not store, publish, share, or distribute content that infringes copyright, trademark, privacy, publicity, database, trade secret, or other rights.

Publishing copyrighted material without permission, license, fair-use justification, or other legal authorization is prohibited. This includes books, articles, paywalled materials, music lyrics, scripts, leaked documents, course materials, software, images, videos, datasets, and any other protected works.

You may not use Vigil Wiki to:

• host piracy materials;
• link to piracy downloads;
• bypass paywalls or access controls;
• distribute copied media or software;
• launder copyrighted material through AI-generated summaries or transformations;
• create archives of copyrighted material you do not have the right to store or publish; or
• evade copyright detection through encoding, chunking, obfuscation, or private-note storage.

Copyright complaints

If you believe material on Vigil Wiki infringes your rights, contact copyright@vigil.wiki with:

• your name and contact information;
• a description of the copyrighted work or other rights at issue;
• the exact vigil.wiki URL or other information sufficient to locate the material;
• a statement that you have a good-faith belief the use is not authorized by the rights owner, its agent, or the law;
• a statement that the information in your notice is accurate; and
• your physical or electronic signature.

We may remove or restrict material, terminate repeat infringers, and take other steps we consider appropriate.

10. Illegal, harmful, and abusive content

You may not use Vigil Wiki to store, publish, distribute, facilitate, promote, or coordinate content or conduct that is unlawful in the United States, Japan, your jurisdiction, our jurisdiction, or any jurisdiction that applies to the relevant activity.

You also may not use Vigil Wiki for content or activity that we determine creates legal, safety, operational, or abuse risk, even if the exact legal status differs by jurisdiction.

Prohibited content and conduct includes, without limitation:

• threats, intimidation, harassment, stalking, doxxing, extortion, blackmail, or non-consensual exposure of private information;
• hate, extremist, or dehumanizing content targeting protected classes or vulnerable groups;
• terrorist or violent extremist praise, recruitment, propaganda, instructions, or coordination;
• credible threats of violence or encouragement of violence;
• self-harm or suicide encouragement, advocacy, instructions, methods, challenges, or coordination;
• child sexual abuse material, sexual exploitation of minors, grooming, or any sexualized content involving minors;
• non-consensual intimate imagery, sexual extortion, or invasive sexual content;
• fraud, phishing, scams, identity theft, credential theft, impersonation, forged documents, or deceptive activity;
• malware, spyware, ransomware, keyloggers, exploit instructions, credential dumps, unauthorized access, or security evasion;
• weapon construction, bomb-making, harmful chemical or biological instructions, or illegal weapons activity;
• illegal drug trafficking or instructions for producing illegal drugs;
• regulated financial, medical, legal, or professional services offered without authorization;
• personal data dumps, leaked databases, or confidential information you are not authorized to store or publish;
• spam, scraping, bulk account creation, rate-limit evasion, automated abuse, or infrastructure attacks; and
• attempts to hide or launder prohibited content through encoding, obfuscation, serialization, deserialization, chunking, or AI rewriting.

Private journaling about difficult experiences is not prohibited merely because it discusses sensitive topics. However, content that instructs, encourages, coordinates, glorifies, or facilitates harm may be removed or restricted.

11. Restricted data

Do not use Vigil Wiki to collect, store, publish, or process:

• payment card numbers or PCI-regulated cardholder data;
• protected health information or medical records;
• social security numbers, My Number identifiers, passport numbers, driver license numbers, or other government identifiers;
• passwords, API keys, private keys, seed phrases, session cookies, MFA/OTP codes, or authentication secrets;
• biometric identifiers;
• precise location tracking data;
• highly sensitive personal data about other people without a lawful basis; or
• data you are legally or contractually prohibited from storing in a third-party note service.

Vigil Wiki is not a regulated records system, medical records system, payment-card vault, password manager, legal archive, or compliance storage product.

12. Prohibited technical conduct

You may not:

• interfere with or disrupt the Service;
• probe, scan, or test the vulnerability of the Service without written authorization;
• bypass authentication, authorization, billing, rate limits, robots controls, or security measures;
• reverse engineer non-public parts of the Service except where law permits;
• use the Service to attack, scan, spam, scrape, or overload another service;
• use bots or automation in a way that harms reliability or violates these Terms;
• create accounts to evade enforcement;
• resell, sublicense, or provide hosted access to Vigil Wiki without permission; or
• misrepresent your relationship with Vigil Wiki, Claude, OpenAI, Anthropic, or any other third party.

13. Enforcement

We may investigate suspected violations of these Terms. Investigations may include reviewing account information, public notes, private notes, metadata, logs, payment status, support communications, and connected-integration activity where reasonably necessary to enforce these Terms, protect the Service, comply with law, or prevent harm.

We may take any action we consider appropriate, including warning you, removing content, unpublishing notes, limiting features, revoking MCP access, suspending or terminating accounts, deleting data, blocking payment methods, preserving evidence, notifying affected users, reporting unlawful conduct, or cooperating with legal authorities.

We are not required to provide advance notice before enforcement if doing so would create legal risk, security risk, harm to others, or risk of evidence destruction.

14. Your responsibilities when using AI-generated content

You are responsible for content created, edited, or published through your account, including content generated or modified by an AI agent.

Before publishing AI-assisted content, you should check it for:

• accuracy;
• copyright or licensing problems;
• confidential information;
• personal data;
• harmful or illegal material;
• false attribution;
• hidden prompt-injection or encoded content; and
• compliance with these Terms.

15. Vigil Wiki intellectual property

Vigil Wiki, vigil.wiki, the Service design, software, logos, branding, interface, visual themes, and related materials are owned by us or our licensors and are protected by intellectual-property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works from the Service or our materials except as allowed by these Terms or with written permission.

16. Third-party services

The Service may interoperate with third-party platforms, including AI clients, OAuth providers, payment processors, hosting providers, and support tools. Third-party services are governed by their own terms and policies. We are not responsible for third-party services, content, products, actions, outages, or data handling.

Vigil Wiki is not endorsed by, sponsored by, or affiliated with OpenAI, Anthropic, Claude, ChatGPT, or any other third-party platform unless expressly stated in writing.

17. Service changes and availability

We may modify, suspend, discontinue, limit, or remove any feature or part of the Service at any time. We may impose limits on storage, rate, note size, publishing, MCP usage, or other usage where needed for reliability, safety, cost control, legal compliance, or abuse prevention.

The Service may be unavailable, delayed, interrupted, or contain errors. You are responsible for keeping your own backups of important material.

18. Disclaimers

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, security, accuracy, and reliability.

We do not guarantee that:

• notes will never be lost, corrupted, or exposed;
• public notes will be removed from all third-party copies after unpublishing;
• AI agents will act correctly;
• generated content will be accurate or lawful;
• the Service will meet your requirements; or
• the Service will be uninterrupted, secure, or error-free.

19. Limitation of liability

To the maximum extent permitted by law, Vigil Wiki and its owners, operators, employees, contractors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost content, business interruption, loss of goodwill, or unauthorized access, even if we were advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the greater of: (a) the amount you paid to Vigil Wiki for the Service during the 12 months before the event giving rise to the claim; or (b) USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you.

20. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Vigil Wiki and its owners, operators, employees, contractors, service providers, and affiliates from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to:

• your use of the Service;
• your User Content;
• your published notes;
• your connected-agent activity;
• your violation of these Terms;
• your violation of law; or
• your violation of another person's rights.

21. Termination

You may stop using the Service at any time. You may request account deletion through available account controls or by contacting support.

We may suspend or terminate your account or access to the Service at any time if we believe you violated these Terms, created legal or safety risk, caused harm to the Service or other users, or used the Service in a way inconsistent with its purpose.

After termination, your right to use the Service ends immediately. We may delete your account data according to our Privacy Policy and retention practices. Terms that by their nature should survive termination will survive, including content responsibility, payment obligations, intellectual-property provisions, disclaimers, limitations of liability, indemnity, and dispute provisions.

22. Governing law and disputes

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. The courts located in Tokyo, Japan (the Tokyo District Court as the court of first instance) will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where applicable consumer-protection law gives you the right to bring claims in the courts of your place of residence.

Nothing in these Terms limits non-waivable rights you may have under consumer-protection, privacy, copyright, or other applicable laws.

23. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms, updating the effective date, or using another reasonable method. Your continued use of the Service after updated Terms take effect means you accept the updated Terms, to the extent permitted by law.
